Resumen : El objetivo principal del estudio fue investigar cuál es el conocimiento sobre el derecho humano a la educación que tiene la población estudiantil de las carreras de la Escuela de Formación Docente de la Facultad de Educación de la Universidad de Costa Rica, a fin de identificar en qué medida han tenido relación con la legislación, las instituciones y las políticas educativas relacionadas con este derecho, así como la importancia que le atribuyen a este derecho para el ejercicio de la docencia en el desarrollo de los procesos educativos y para las finalidades de la educación en general. La investigación es de carácter cualitativo y cuantitativo y su enfoque se basa predominantemente en la teoría crítica de la educación. Se buscó analizar y profundizar de manera crítica en el tema de la investigación, en procura de identificar cuál es el estado de la cuestión y, a partir de ello, proponer alternativas que conduzcan a fortalecer los procesos de la formación docente universitaria en perspectiva de la educación en derechos humanos Se realizó un análisis de documentos de la política educativa costarricense promulgados por el Consejo Superior de Educación y el MEP entre 1994 y 2016. Se diseñó un cuestionario con preguntas abiertas y cerradas, elaborado con base en las pautas y componentes del derecho humano a la educación identificadas en la etapa de estudio de la documentación. La población de estudio es la población estudiantil de las carreras de Formación Docente de la Facultad de Educación de la Universidad de Costa Rica. El cuestionario se compartió en línea y por correo electrónico por medio de la plataforma “Google Forms”, entre los meses de mayo a julio de 2021. Entre las consideraciones finales del estudio se encuentran las siguientes: A lo largo del último cuarto de siglo, el enfoque de los derechos humanos alcanzó a ocupar un lugar de primer orden en la educación y en otras diversas esferas de la cultura y de la institucionalidad del Estado. Entretanto, por su parte, en no pocos espacios y en las posiciones de distintos actores, no se cierra todavía la discusión ni los debates acerca de la verificación de las prácticas sociales e institucionales que deban dar sustentación al cumplimiento de estos derechos. Las reticencias y las discrepancias son recurrentes, cada vez que se aborda la tarea por definir y determinar la validez y los alcances que deben otorgársele a estos derechos. En Costa Rica, la inclusión del “tema de los derechos humanos” en el currículo del sistema educativo nacional tuvo lugar a inicios de siglo. Sin embargo, transcurrida más de década y media, recién es que, por ejemplo, en el campo de la investigación en educación, empieza a emerger el interés por indagar qué ha ocurrido al respecto desde entonces. De la diversa documentación relacionada con declaraciones, pactos y convenciones internacionales sobre derechos humanos, la gran mayoría de ella promulgada por las Naciones Unidas y sus organismos especializados (principalmente el ACNUDH, la UNESCO y UNICEF), las personas informantes refieren tener poco conocimiento. El estudio de la teoría de estos derechos y la reflexión sobre la pertinencia e importancia de una educación con enfoque de derechos humanos no parecen haber sido todavía tomados en cuenta. Situación similar acontece con la legislación nacional y las instituciones creadas en Costa Rica con la finalidad de promover la cultura de los derechos humanos y proteger y defender estos derechos.
ABSTRACT: The main objective of the study was to investigate what is the knowledge about the human right to education that the student population who study careers in the School of Teacher Training at Faculty of Education at the University of Costa Rica promote, in order to identify in what extent have been related to legislation, institutions and educational policies related to this right, as well as the importance they attribute to this right for the exercise of teaching in the development of educational processes and for the purposes of education in general. The research is qualitative and quantitative in nature and its approach is predominantly based on critical educational theory. We searched for to critically analyze and delve into the subject of the research, seeking to identify the state of the art and, from this, to propose alternatives that lead to strengthening the processes of university teacher training in perspective of the human rights education An analysis of Costa Rican educational policy documents promulgated by the Higher Council of Education and the MEP between 1994 and 2016 was carried out. A questionnaire with open and closed questions was presented, prepared based on the guidelines and components of the human right to education identified in the documentation study stage. The study population is the student population of the Teacher Training careers of the Faculty of Education at the University of Costa Rica. The questionnaire was shared online and by email through the "Google Forms" platform, between the months of May to July 2021. Among the final considerations of the study are the following: Throughout the last quarter of a century, the human rights approach has come to occupy a prominent place in education and in other diverse spheres of culture and State institutions. Meanwhile, for its part, in many spaces and in the positions of different actors, the discussion and debates about the verification of social and institutional practices that should support the fulfillment of these rights have not yet ended. Reticence and discrepancies are recurrent, each time the task of defining and determining the validity and scope that should be granted to these rights is tackled. In Costa Rica, the inclusion of the "theme of human rights" in the curriculum of the national educational system took place at the beginning of the century. However, after more than a decade and a half, it is only recently that, for instance, in the field of education research, interest on investigating what has happened in this regard since then begins to emerge. Of the diverse documentation related to international declarations, pacts and conventions on human rights, the great majority of it promulgated by the United Nations and its specialized agencies (mainly the OHCHR, UNESCO and UNICEF), the informants report having little knowledge. The study of the theory of these rights and the reflection on the pertinence and importance of an education with a human rights approach do not seem to have been taken into account yet. A similar situation occurs with national legislation and the institutions created in Costa Rica for the purpose of promoting the culture of human rights and protecting and defending these rights.
