El derecho a la educación como derecho humano en el sistema educativo costarricense: Estado de la cuestión.

Abstract

Este documento tiene por finalidad presentar los resultados de una investigación realizada entre los años 2017 y 2018, inscrita en el marco de las actividades académicas que se llevan a cabo en el Observatorio de la Educación Nacional y Regional (OBSED) del Instituto de Investigación en Educación (INIE), Universidad de Costa Rica (UCR). La investigación titulada El derecho a la educación como derecho humano en la política educativa costarricense: 1995/2015 tomó como objeto de estudio las políticas educativas promulgadas en Costa Rica a partir de la Política Educativa hacia el Siglo XXI, aprobada por el Consejo Superior de Educación en 1994. Asimismo, se toman en cuenta las diferentes leyes que, en materia de protección de los derechos humanos, han sido establecidas en Costa Rica, además de los principales programas creados por el Ministerio de Educación Pública (MEP) y otras instituciones con la finalidad de dar cobertura y cumplimiento al derecho humano a la educación en el sistema educativo costarricense El estudio que representó el desarrollo de esta investigación deja claro que, sobre todo en este momento, cuando las desigualdades sociales, la exclusión y la inequidad se incrementan y afectan de manera drástica a alrededor de un tercio de la población del país, la perspectiva del derecho humano a la educación proporciona un marco de referencia heurística de especial importancia, el cual sirve para enlazar con el estudio también de los temas de la justicia social y de los alcances que puede tener la institucionalidad de la democracia para garantizar el cumplimiento del derecho humano a la educación y de los derechos humanos en general. Se trata de una articulación de distintos vértices de indagación que, además de dar cuenta de la situación en que se está, de la misma manera, proporciona elementos para discernir las rutas por seguir, en procura de la construcción de una sociedad basada en la justicia social, el bienestar común, la democracia y el respeto a la dignidad humana.

ABSTRACT: The purpose of this document is to present the results of an investigation carried out between the years 2017 and 2018, registered within the framework of the academic activities carried out at the Observatory of National and Regional Education (OBSED) of the Institute for Research in Education (INIE), University of Costa Rica (UCR).
